Terms of Service

Please read these Terms of Service ("Terms") carefully before using OrbitKit ("Service"), operated by OrbitKit ("we," "us," or "our").

By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

OrbitKit is a software-as-a-service platform that helps iOS and macOS developers create and host web pages and files required by Apple for App Store submission. The Service may include, but is not limited to:

• A privacy policy generation wizard
• Support page and data deletion page generators
• Hosting of your app's privacy policy, support, and data deletion pages
• Universal Links, App Clips, Passkeys, and Handoff configuration (AASA file)
• Smart App Banner integration
• Well-known file hosting (Sign in with Apple, Apple Pay)
• Custom domain support with SSL

2. Not Legal Advice

• Generated privacy policies are templates, not tailored legal documents
• We make no warranty that generated policies comply with any specific law, regulation, or App Store requirement
• You are solely responsible for ensuring your privacy policy is accurate, complete, and legally compliant
• We strongly recommend having an attorney review your privacy policy before publishing

3. Accounts and Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One account per person or entity

4. Subscriptions and Billing

Pricing

• Monthly plan — $5 per month
• Yearly plan — $50 per year (save ~17%)

Billing Terms

• Subscriptions are billed in advance on a recurring basis
• You can switch between monthly and yearly plans at any time via the billing portal
• All fees are in US Dollars and are non-refundable except as required by law
• We reserve the right to change pricing with 30 days' notice

Cancellation

• You may cancel your subscription at any time via the billing portal
• Upon cancellation, your site will remain live until the end of the current billing period
• After the billing period ends, your site will be taken offline
• Your data will be retained for 30 days after the billing period ends, then permanently deleted

5. Acceptable Use

You agree NOT to use the Service to:

• Host content for illegal apps or services
• Host content for malware, spyware, or other malicious software
• Impersonate another person, company, or entity
• Host content that violates any third party's intellectual property rights
• Distribute spam, phishing, or fraudulent content
• Engage in any activity that could damage, disable, or impair the Service
• Attempt to gain unauthorized access to the Service or its systems

We reserve the right to suspend or terminate accounts that violate these terms.

6. Content and Intellectual Property

Your Content

• You retain ownership of all content you provide (app name, description, icon, wizard responses)
• You grant us a limited license to host, display, and serve your content as part of the Service
• You represent that you have the right to use all content you upload (including app icons)

Our Content

• OrbitKit's website, code, design, and templates are our intellectual property
• Generated privacy policies may be freely used by you for any purpose

7. Data Handling

• See our Privacy Policy for details on how we handle your data
• Upon account deletion, we delete all your data within 30 days
• We maintain backups for disaster recovery purposes; backups are purged within 90 days

8. Limitation of Liability

• Our total liability is limited to the lesser of (a) the fees you paid in the 12 months preceding the claim, or (b) $100
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

9. Indemnification

You agree to indemnify and hold harmless OrbitKit from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• The content of your generated privacy policy
• Any claim that your privacy policy is inaccurate, incomplete, or non-compliant

10. Service Availability

• We aim for high availability but do not guarantee uninterrupted service
• We may perform maintenance with reasonable notice
• We reserve the right to modify or discontinue the Service with 30 days' notice
• In the event of discontinuation, we will provide data export capabilities

11. Modifications to Terms

• We may modify these Terms at any time
• Material changes will be communicated via email at least 30 days in advance
• Continued use of the Service after changes constitutes acceptance
• If you disagree with changes, you may cancel your subscription

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.

13. Dispute Resolution

• Any disputes will first be attempted to be resolved through informal negotiation
• If informal resolution fails, disputes will be resolved through binding arbitration
• Arbitration will be conducted under the rules of the American Arbitration Association
• You waive the right to participate in class action lawsuits

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
